What is Urea Formaldehyde Foam Insulation Warranty (UFFI) and how does it impact the buyers and sellers of homes in Ontario?

Many years ago, UFFI (now a banned substance) was used as a form of building insulation. This foam was injected into spaces behind walls where other types of insulation could not reach. The Canadian government banned UFFI in 1980 due to the apparent health issues resulting from its use. This substance is still widely used in Europe and other parts of the world.

UFFI warranty was implemented to give the buyers some ease regarding the potential health risk that UFFI could pose to them. When a seller gives the warranty that they have not used UFFI to insulate the property and that to the best of their knowledge there is no UFFI in the building, that warranty survives the closing of the transaction.

UFFI clause is included in the agreement of purchase and sale, however if you need to add additional clauses related to other toxic and hazardous substances such as mold and asbestos, please consult with a real estate lawyer in Mississauga.
